İSKANDİNAVYA ÇOCUK OMBUDSMANLIĞI SİSTEMİ VE TÜRKİYE’YE UYGULANABİLİRLİĞİ

Abstract

Öz:Çocuk ombudsmanı, çocukların yasal olarak korunmasını geliştirmeye yönelik güvence sağlayan vesavunmasız konumdaki çocuklarla ilgili her türlü şikâyeti inceleyen, tavsiye kararı alan bir kamu otoritesidir. Çocukların toplum genelinde ve tüm kurumlardaihtiyaç ve çıkarlarını öncelikle savunan İskandinavyaÇocuk Ombudsmanlığı; çocukların sahip olduklarıhakların ihlal edilmesi durumunda onların başvuracakları yol ve yöntemleri öğrenmeyi kolaylaştırmaktave zor durumdaki çocukların haklarını korumayı üstlenmektedir. Bu ombudsmanlık türü ile özellikle Birleşmiş Milletler Çocuk Hakları Sözleşmesi ve ilgili yasal düzenlemeler çerçevesinde çocukların her alandakorunması ve haklarının geliştirilmesi öngörülmektedir. Çalışmada önce İskandinavya ülkelerindeki çocukombudsmanlığına ait özellikler ve uygulamalar açıklanmış; sonra Türkiye’de çocuk ombudsmanlığınınuygulanabilirliği yasal ve kurumsal düzenlemelerüzerinden tartışılmıştır. Bu kapsamda çalışmada İskandinavya ülkelerinde uzun zamandan beri varlığınısürdüren Çocuk Ombudsmanlığı Kurumunun temelözellikleri ve işleyişi ele alınarak, Türkiye’de KamuDenetçiliği Kurumu’na bağlı veya ayrı bir kurumsalyapı olarak alanında uzmanlaşmış bir Çocuk Ombudsmanlığının kurulmasının gerekliliği incelenmiştir.Bu çalışmada nitel yaklaşım bağlamında dolaylı vealıntısal bir araştırma yöntemi kullanılmıştır.

Öz:Ombudsman for Children is an independent public authority that provides an assurance to improve the legal protection of children, reviews all complaints about vulnerable children, and makes recommendations. The Scandinavian Ombudsman for Children, which primarily defends the needs and interests of children in society and throughout all institutions, facilitates learning the manners and methods to apply in case of violation of children’s rights, and undertakes to protect the rights of children in distress. This type of ombudsmanship envisages the protection and development of children’s rights in all areas, especially within the framework of the United Nations Convention on the Rights of the Child and the relevant legal regulations. In the study, the characteristics and practices of Ombudsman for Children in Scandinavian countries were explained first, and then the applicability of Ombudsman for Children in Turkey was discussed through legal and institutional regulations. In this context, the study investigated the basic characteristics and methods of implementation of the Ombudsman Institution for Children, which has existed in Scandinavian countries for a long time, and the requirements for the establishment of a specialized Ombudsmanship for Children in Turkey which is affiliated to the Ombudsman institution or as a separate organizational structure.
