Tanımlanması ve içeriğinin belirlenmesi oldukça güç olmakla birlikte önemli bir yapısal sorun olan kayıt dışı ekonomi ve bunun emek piyasalarına yansıyan şekli olan kayıt dışı istihdam, ülkemizin karşı karşıya kaldığı en önemli sosyo-ekonomik problemlerden biridir. Başta ekonomik ve mali nedenler olmak üzere diğer pek çok faktörün etkileşimiyle birlikte ortaya çıkarak çok boyutlu bir hâle bürünen ve doğası gereği tam olarak ölçülebilmesi mümkün olmayan kayıt dışı ekonominin/istihdamın kayıtlı ekonomiye/istihdama oranının yaklaşık 1/3'ü bulduğu Türkiye ekonomisinde, kaynak dağılımının etkinleştirilip, dengeli ve sağlıklı bir büyümenin ve kalkınmanın gerçekleştirilebilmesi için acilen çözülmesi gerekliliği ortaya çıkmakta ve bu nedenle kayıt dışı ekonomi ve kayıt dışı istihdamla mücadele edilmesi ve tedbirler alınması zorunlu hâle gelmektedir. Bu tez çalışmasında kayıt dışı istihdamın çalışanlar üzerinde mali etkisinin neler olduğu sorusuna yanıt aranmış ve kayıt dışı istihdam edilmenin çalışanların kendisi ya da geride bıraktıkları üzerindeki maddi kayıplarının neler olabileceği iş ve sosyal güvenlik hukuku bağlamında incelenmeye çalışılmıştır. Söz konusu inceleme yapılırken kamu kurum ve kuruluşlarının yayınladığı resmi rakamlar göz önünde bulundurulmuş ve dönem sınırlamasına gidilmiştir. Kayıt dışı ekonominin kısa vadede vasıfsız emeğe iş bulup istihdam yaratarak işsizliği azalttığı ve bu kesimlerin gelir elde etmesine olanak tanıması şeklinde olumlu bir etkisinin olduğu ifade edilmesine karşın uzun vadede öncelikle kamu gelirlerinin azalmasına, sonrasında ise ekonomik, mali, sosyal ve hatta demografik yapının bozulmasına yol açarak çok daha fazla olumsuz etkiye sahiptir. İşletmeler açısından piyasadaki rekabet yapısının bozulup haksız rekabetin ortaya çıkmasına; devlet açısından ise vergi ve sigorta primi gibi zorunlu yükümlülüklerin yerine getirilmemesine bağlı olarak sosyal güvenlik sisteminin daha fazla açık vermesine ve nüfusun da giderek yaşlanmasına bağlı olarak sistemin sürdürülebilirliğini etkilemektedir. Geçimini emeğiyle sağlayanlar söz konusu bu olumsuz etkiden, devlete ve işverenlere nazaran daha fazla etkilenmekte ve gerek iş hukukunun gerekse de sosyal güvenlik hukukunun koruyucu hükümlerinin dışında kalmaktadır. Kayıt dışı istihdam edilenlerin iş hukuku açısından değerlendirmesi yapıldığında işçiye bir nebze de olsa güvence sağlayan işsizlik ödeneği ile tazminatların alınamaması ya da eksik alınmasının yanında çalışma ve dinlenme sürelerine riayet edilmeyerek hak kayıplarını ortaya çıkarmaktadır. Bunun yanında sigorta primlerinin ödenmemesi ya da eksik ödenmesine bağlı olarak sosyal güvenlik sisteminden sağlanan kısa ve uzun vadeli yardımlardan da çalışanın kendisinin veya geride bıraktıklarının yararlanamama durumu ortaya çıkmaktadır.
Although it is very difficult to define and determine its content, informal economy, which is an important structural problem, and informal employment, which is the form of this reflected in the labor markets, is one of the most important socio-economic problems that our country faces. In the Turkish economy, where the ratio of informal economy/employment to formal economy/employment, which has become multidimensional by the interaction of many other factors, especially economic and financial reasons, and which cannot be measured precisely due to its nature, is approximately 1/3 of the resource distribution. In order to be activated and achieve a balanced and healthy growth and development, the need to be solved urgently emerges, and therefore it becomes necessary to fight against the informal economy and unregistered employment and to take measures. In this thesis, the answers to the question that what the financial impacts of unregistered employment on the employees and it has been tried to examine what could be the financial losses of unregistered employment on the employees themselves or what they leave behind in the context of labor and social security law. While the mentioned examination was being done, the official numbers that the were published by public institutions and organizations were taken into consideration and a period limitation was applied. Although it is stated that the informal economy has a positive effect in the short term by finding jobs for unskilled labor and creating employment, it reduces unemployment and allows these segments to earn income, but in the long run, it primarily leads to a decrease in public revenues and then to the deterioration of the economic, financial, social and even demographic structure which means it has much more negative impacts. In terms of the state, it affects the deterioration of the competitive structure in the market in terms of businesses and the emergence of unfair competition; the sustainability of the system due to the fact that the social security system gives more deficit due to the failure to fulfill mandatory obligations such as taxes and insurance premiums and the aging population gradually. Those who make a living with their labor are more affected by this negative effect than the state and employers and are excluded from the protective provisions of both labor law and social security law. When the informal employment is evaluated in terms of labor law, unemployment benefits and compensations, which provide some assurance to the worker, are not received or received incompletely, as well as the loss of rights by not complying with the working and rest periods. Additionally, due to non-payment or incomplete payment of insurance premiums, the situation of not being able to benefit from the short and long-term benefits provided by the social security system, either by the employee himself or by the ones he or she leaves behind, arises.
