Öz:İdari Yargılama Usulü Kanunu'nun 2. maddesinde iptal davası; İdarî işlemler(in)... iptalleri için menfaatleri ihlal edilenler tarafından açılan davalar olarak tanımlanmaktadır. İdari yargıda iptal davası açabilmek için, adli mahkemelerinden farklı bir şekilde ve doğası gereği bir genişleme kaygısı güdülmüştür. Gerekçe ise, idari işlemin idare tarafından tek yanlı yapılması, yapılan işlemin icrai olması yani hemen uygulanabilmesi ve hukuka aykırılığı ispatlanana dek işlemin hukuka uygunluk karinesinden yararlanmasıdır. Tüm bu sebeplerden dolayı (ve tam yargı davasında aranan hak ihlali koşulu yerine) menfaat ihlali koşulunun aranması zorunluluk haline gelmiştir. Bu makalede menfaat ihlalinin anlamı, hukuksal rejimi ve tarihsel süreçte geçirdiği evreler ele alınacak olup; daha sonra somut yargı kararları ışığında çeşitli menfaat grupları açısından sorunlu alanlar göz önüne serilmeye çalışılacaktır.
