Toplumsal sözleşme teorisi siyaset felsefesi, siyasal teori ve kamu hukuku gibi akademikdisiplinler için oldukça önemli bir düşünsel momenti ifade eder. Bu makale Thomas Hobbes ve John Locke’un toplumsal sözleşme teorileri arasındaki ilişkinin belirli bir veçhesineodaklanmaktadır. Bu veçhe doğa durumu kavrayışları birbirine zıt görünen iki düşünür arasında toplum sözleşmesi teorisi açısından bir süreklilik mi yoksa kopuş mu olduğu sorusuylasınırlandırılmaktadır. Bu bağlamda makalede ilk olarak Hobbes ve Locke’un doğa durumutasavvurları özetlenecektir. Ardından bu iki düşünürün eserlerindeki devletin ortaya çıkışı izleğinin; bir diğer deyişle devlet düşüncesinin, düşünürlerin ilgili doğa durumu kavrayışlarıtarafından ön-belirlenen kuramsal inşasının, temel hatları belirlenecektir. Son olaraksa MarcNeocleous’un Güvenliğin Eleştirisi başlıklı kitabında yer alan John Locke’a ilişkin eleştirelanaliz doğrultusunda, Locke’un düşüncesindeki istisnai yönetim ilkesi, yani imtiyaz kavramıele alınacak ve bu kavramın Locke ile Hobbes arasında, bu iki düşünürün doğa durumu kavrayışlarındaki farkta temellenen bir kopuştan ziyade bu farklılığı askıya alan bir süreklilik tesisettiği tartışılacaktır.
Social contract theory expresses a very important intellectual moment for academic disciplines such as political philosophy, political theory and public law. This article focuses on a particular aspect of the relationship between Thomas Hobbes and John Locke’s theories of social contract. This aspect is limited to the question of whether there is a continuity or disengagement between the two thinkers who differ in their understanding of the state of nature, in terms of social contract theory. In this context, fistly, Hobbes and Locke’s thoughts of state of nature will be summarized. Then, the basic lines of the emergence of the state in the works of these two thinkers, in other words, the theoretical construction of the state pre-determined by the philosophers’ understanding of the relevant state of nature, will be treated. Finally, in line with the critical analysis of John Locke in Marc Neocleous’s Critique of Security, the concept of prerogative will be discussed and it will be argued that this concept establishes a continuum between Locke and Hobbes, rather than a rupture based on the difference in the understanding of the state of nature of the thinkers.
